[Ramallah, 24 November 2009] On 23 November 2009, after 61 days of detention for the purpose of interrogation by Israeli Security Agency officers, human rights defender Mohammad Othman received his first administrative detention order. The administrative detention order is set for a three month period, during which time Mohammad will be held without charge or trial. The judicial review of the order is scheduled to take place on 25 November at the Military Court of Administrative Detainees in Ofer Military Base, near the West Bank city of Ramallah.

29 days after Mohammad’s arrest still no charges have been laid
[Ramallah, 20 October 2009] On Monday 19 October 2009, a court hearing at Salem military court, in the Northern West Bank, extended Mohammad Othman’s detention period for another 11 days. It has been 29 days now since human rights defender, Mohammad Othman was arrested at the Allenby Bridge Border Crossing between Jordan and the West Bank. Mohammad, who volunteers with the “Grassroots Stop the Wall Campaign”, was on his way back to Ramallah from an advocacy tour in Norway, during which he was engaged in a number of speaking events and meetings with government officials. Monday’s court hearing was Mohammad’s third since the moment of his arrest on 22 September 2009. The two previous hearings have consistently extended Mohammad’s detention period for 10 and 12 days respectively, although no clear allegations have been made against Mohammad and no external evidence was brought to the attention of the court. Arrests of individuals based on reasonable suspicions are admissible in the beginning of one’s detention. However, after one month of continuous interrogation, such suspicions need to be substantiated and built upon by external evidence if any fair trial standards are to be upheld. Based on Israeli military orders, a military judge can authorize the detention of Palestinian detainees for up to 90 days, which can be extended for another 90 days by the judge of the Military Appeal Court.

HaMoked has issued a joint report with
B’Tselem criticizing Israel’s detention of Palestinians without trial. In the report, they make the case that the policy of extensive detentions breaches international law, which permits use of administrative detention only in very extreme cases.
The numbers are extreme: during the second intifada, more than 1,000 Palestinians were held simultaneously in administrative detention. In recent months, there has been a steady decrease in the number of detainees: on 30 September 2009, the number stood at 335, among them three women and one minor. Of these, some 37 percent have been held from six months to a year and some 33 percent for one year to two years. 28 Palestinians have been in administrative detention for two to four years, and one has been detained for more than four and a half years.

PLC Member Basim Za’rir was arrested on 1 January 2009, when Israeli occupation forces arrived at his home just after 2:00am. After beating Basim’s eldest son, searching the house, and ordering and interrogating all the men above the age of 16 living in the house nearby, they arrested Mr Za’rir. He was taken to Etzion detention centre where he remained for a week before being transferred to Ofer. He was then placed under an administrative detention order and kept in detention for approximately two months before being transferred again to Ketziot prison in the Negev where he still remains. The administrative detention order against Mr. Za’rir was for a six month period, lasting from his arrest on 1 January 2009 until 2 July 2009. His attorney filed an appeal on Mr. Za’rir’s behalf, challenging this order less than a month after the judicial review took place, but the appeal was denied. On 2 July, instead of being released, Mr. Za’rir was informed that his administrative detention order would be extended for another six months. The judge at the judicial review for the second order confirmed the additional six month period, setting the current order’s expiration date for 1 January 2010.

Majeda Fidda is an elected member of Nablus municipality Council. She was arrested from the family home in Nablus. A few minutes passed midnight on 6 August 2008 Israeli soldiers stormed her house and proceeded to a search. Five months later, on 31 December 2008 she was acquitted of all charges and subsequently placed under administrative detention. Her order is expected to end on 30 June 2009. Please write to the Israeli government, military and legal authorities and demand that Ms Majeda Fidda be released immediately and that her administrative detention not be renewed.

Siham Al Heh is a social worker from Sourif in Hebron. Siham was arrested from her family home at 1:30 am on 26 March 2009. A few days following her arrest, Siham was informed that she would be detained for a 3 month period in administrative detention, without charge or trial. Her potential – but by no means certain – release is now expected on 25 June 2009.
